Delaware VOCAL is a service provided by the State of Delaware Department of Labor, hereinafter Delaware VOCAL, and funded through a Reemployment and System Integration Dislocated Worker Grant (RSI-DWG) received by Delaware Department of Labor, Division of Employment and Training. America’s Job Link Alliance–Technical Support (AJLA–TS) maintains the Website.

As is true for many other websites, this site has rules that apply to your use of or participation in the site and any services available through it. Those rules, referred to as “Terms of Use,” are set forth below. By using the Website, you are agreeing to comply with, and be bound by, the following Terms of Use. Please review them carefully.

All references to Delaware VOCAL in this Terms of Use refer to and include the State of Delaware, which operates Delaware VOCAL.

You agree that this Terms of Use constitutes the entire agreement between you and Delaware VOCAL with respect to your use of the Website. Delaware VOCAL may amend this Terms of Use at any time without specific notice to you. The latest Terms of Use will be posted on the Website, and you should periodically check this Terms of Use for changes. Delaware VOCAL is providing this information (the “Website”) as a public service, and the information contained within it is continually under development. Users of Delaware VOCAL should be aware that, while we try to keep the information on this Website timely and accurate, neither the Delaware VOCAL nor AJLA–TS checks the accuracy of all information contained on this website. Delaware VOCAL respects the intellectual property of others and asks you to do the same. Delaware VOCAL reserves the right, but not the obligation, to terminate your use of the Website if it determines in its sole and absolute discretion that you are involved in infringing activity, including alleged acts of first-time or repeat infringement, regardless of whether the material or activity is ultimately determined to be infringing.

Indemnification

You agree to defend, indemnify, and hold harmless Delaware VOCAL, Delaware JobLink, the State of Delaware, AJLA–TS and their affiliates and their respective officers, employees, and agents from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or related to (a) any material posted or otherwise provided by you that infringes any copyright, trademark, trade secret, patent, or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by you in connection with your use of the Website; (c) any violation by you of this Terms of Use; and (d) any claims brought by other persons or entities arising from or related to your use of the Website, including information obtained through the Website.

In addition, any written notice regarding any defamatory or infringing activity, whether of a copyright, patent, trademark, or other proprietary right, should be sent to Delaware VOCAL, listed above, and must include the following information:

Prohibited Behavior

You are prohibited from using the Website in any way to do any of the following:

Use of Live Chat

Delaware VOCAL includes a live chat feature so that job seekers can reach out to staff for assistance. You may be asked to provide information such as your username, first and last name, or email address so that staff can assist you with your account. We will never ask for, nor should you ever provide, specific Personally Indefinable Information (PII) such as your Social Security number or date of birth. All messages to and from the chat agent are secured with 256-bit SSL encryption between each component of the communications path. Chat message histories will be stored and secured consistent with industry standard practices.

When a Delaware VOCAL staff member is not available to respond to your chat, messages may be sent from an automated response system (chatbot). Any automated responses will be identified as computer generated. These computer-generated messages are not moderated by Delaware VOCAL staff. You can verify any information provided to you by the chatbot service by submitting questions to delawarejoblink@delaware.gov.

Monitoring

You understand that Delaware VOCAL has no obligation to monitor the Website. However, Delaware VOCAL reserves the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, or to refuse to post or to remove any information or materials, in whole or in part, that in Delaware VOCAL 's sole and absolute discretion are objectionable or in violation of this Terms of Use. You acknowledge that Delaware VOCAL reserves the right to, and may from time to time, monitor any and all information transmitted or received through the Website, for operational and other purposes, subject to Delaware VOCAL’s Privacy Policy. Submissions

Delaware VOCAL is pleased to hear from users and welcomes your comments regarding the Website. If you submit any original creative ideas, suggestions, notes, concepts or materials (“Submissions”), they shall be deemed, and shall remain, the property of Delaware VOCAL, and shall otherwise be subject to the provisions of this Terms of Use. None of the Submissions shall be subject to any obligation of confidence on the part of Delaware VOCAL, and Delaware VOCAL shall not be liable for any use or disclosure of any Submissions. Without limitation of the foregoing, the State of Delaware VOCAL, shall exclusively own all now known or hereafter existing worldwide rights to the Submissions of every kind and nature and shall be entitled to unrestricted use of the Submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Submissions.

Minors

This website is not intended for use by minors under the age of eighteen (18) and by using this website you agree that you are at least eighteen (18) years of age. If you have agreed to allow your minor child, or a child for whom you are legal guardian (a “Minor”), to use the Website, you agree that you shall be solely responsible for: (a) the online conduct of such Minor; (b) monitoring such Minor's access to and use of the Website; and (c) the consequences of any use of the Website by such Minor.
